Terms of service
Who we are and when these terms apply
Sweat Shop Noosa is operated by Johnson Street Pty Ltd Trading as Noosa Sweat Shop, ABN 85 641 362 192 at Unit 2, 28 Lionel Donovan Drive, Noosaville, Queensland. In these terms, “we”, “us” and “our” mean that business.
These terms apply to goods and services you order from us online, through our linked ordering tools, by email or in person. We make them available before you place an order or accept a quote. An enquiry or Print + Cut upload is a request for a quote, not a confirmed production order.
Any specific conditions agreed in writing for your order form part of our agreement. Nothing in these terms excludes or limits rights or remedies that cannot lawfully be excluded, including under the Australian Consumer Law.
Quotes prices and payment
All prices are in Australian dollars. Consumer-facing website prices include GST. Quotes show whether individual amounts include or exclude GST and show the total payable. Freight and additional services are identified before you commit to them.
Quotes are valid for 14 days unless a different period is stated. Changes to quantities, garment styles, artwork, decoration positions or finishing may require a revised quote. We will obtain your agreement before doing additional chargeable work. Supplier cost increases do not automatically change an accepted order price.
Online purchases are payable in full at checkout. For quoted work, the quote or invoice states the required payment, any deposit and when the balance is due. Production begins once the required payment, order information and applicable approvals are received.
Quantity discounts apply according to the conditions displayed for the relevant product or quote. Different services and products may have different quantity tiers.
Order details and garment availability
Please check garment style, colour, size, quantity, decoration positions and delivery details before ordering. Use the size chart for the specific garment; sizes can differ between styles and brands. Tell us about any essential fit, colour, fabric or deadline requirements before committing to an order.
Garment availability can change. We will contact you if an ordered item becomes unavailable and offer an agreed alternative, revised timing or a refund for the unavailable item. We will not substitute garments without your approval. If a partial supply would defeat the purpose you told us about, we will discuss an appropriate solution for the affected order.
Artwork and approval
You must own, or have permission to reproduce, the artwork, logos, photographs and wording you supply. You give us permission to use and share those files with the service providers needed to complete your order. This does not transfer ownership of your artwork to us.
Follow the upload requirements for your chosen service. Check spelling, resolution, transparency, dimensions and placement. Artwork preparation, background removal, embroidery digitising and design assistance are separate services unless included in your quote. Any fee will be agreed first.
Where we provide a proof, check all details and approve it in writing before production. Payment does not approve a proof you have not seen. For self-service orders, the design you submit at checkout is your production instruction; a separate proof is supplied only if agreed. Approval does not excuse us from reproducing the agreed design with due care and skill.
Printing and transfer services
Colour placement and embroidery
Screen previews guide layout but cannot show printed colour, fabric texture or embroidery exactly. Garment sizes and seams can also affect the appearance of the same design. Tell us before ordering if exact colour, dimensions or placement are essential so we can discuss feasibility and any sample or testing costs.
We will explain relevant production limitations and agree any specific tolerances before production. We do not treat every difference as acceptable simply because a preview was approved. Your rights concerning faulty goods, misleading descriptions or work that does not meet agreed specifications remain unchanged.
Embroidery may require digitising and adjustments to fine detail, lettering or stitch coverage. Material design changes and extra charges require your approval. Ownership and delivery of design work or digitised production files created by us will be stated in the design quote.
Print only gang sheets
The gang sheet builder is a self-service option for customers supplying their own artwork. Select the sheet size and quantity shown for the product, then check the finished size of every design, image quality, background transparency, spacing and complete layout before checkout.
We print the submitted layout and supply the sheet uncut. Rearranging artwork, correcting spelling, removing backgrounds and checking every design are not included unless separately agreed. If we identify a file problem, we may pause the order and contact you about a solution before proceeding.
Print-only orders include transfers only. Garments, cutting and heat-press application are not included. We remain responsible for producing the ordered transfers to the agreed specifications.
Precision cut transfers
For Print + Cut, upload individual artwork files and tell us the finished size and quantity required for each design. Do not submit a completed gang sheet unless we ask for one. Our team prepares the layout in the software used for cutting.
We review the request and provide a quote covering printing, cutting and any artwork preparation. Submitting the form does not authorise production or take payment. We proceed after you accept the quote, provide any required approval and make the required payment.
Cutting prepares separate transfers for pressing; it does not include applying them to garments. Any requirements for the cut shape, border, sorting or packaging must be agreed in the quote.
Applying and caring for transfers
Follow the application and storage instructions supplied for your transfers and use a suitable heat press and compatible fabric. Tell us before purchase about unusual fabrics, coatings or specialist uses so we can advise on suitability.
Before a larger run, test on the intended fabric using the supplied instructions. Results can be affected by press temperature, pressure, timing, peeling method and fabric compatibility. We are not responsible for damage caused solely by incorrect application or storage, but this does not exclude responsibility for defective transfers or incorrect advice we provide.
For decorated garments, follow the garment care label and our decoration care instructions. If you notice a problem, stop using the affected items where practical and contact us so we can assess it.
Customer supplied garments
We accept customer-supplied garments only by prior agreement. Tell us the fabric composition, condition, approximate replacement value and any special treatment or coating. We may recommend testing or decline unsuitable items before accepting the job.
We will explain known risks and obtain approval before any agreed test or process likely to alter an item. Pre-existing defects and problems caused solely by undisclosed or unsuitable materials are assessed according to their cause. We remain responsible for the care and skill of our work and any remedies required by law; supplying your own garment does not waive those rights.
Timing changes and delivery
Turnaround and urgent orders
We confirm production timing for your order once the necessary information, stock, payment and approvals are in place. Tell us your required date before ordering, especially for events. An urgent service is available only when we confirm capacity and any additional fee.
Dispatch dates and delivery estimates are different. We will state whether a date is an estimate or an agreed essential deadline. If delays arise, we will contact you promptly, explain the position and discuss alternatives and any cancellation or refund rights. We do not guarantee a turnaround simply because an order has been submitted.
Changes and cancellations
Contact us as soon as you need to change or cancel an order. We will check its progress before confirming what is possible. Changes may affect the agreed price and completion date, and we will obtain your agreement before proceeding.
For a change-of-mind cancellation before production, any amount retained will reflect reasonable, evidenced work already completed and non-recoverable costs committed specifically for your order, after taking account of costs we can avoid or recover. We will explain those costs and refund the balance. A deposit is not automatically non-refundable.
Once custom production has started, changes or a change-of-mind cancellation may not be possible. Any cancellation charge will reflect the stage reached and actual reasonable loss, without double recovery. This does not restrict cancellation, refund or other rights arising from our failure to meet the agreement or the law.
Delivery and collection
Delivery charges and available services are shown at checkout or in your quote. Please provide a complete address and contact details. If you ask us to change the address after dispatch, or an incorrect address you supplied causes a redelivery, we will discuss any actual additional cost with you.
If a delivery we arrange is lost, damaged or significantly delayed, contact us. We will investigate with the carrier and provide the remedy required for the circumstances. We do not require you to resolve our delivery arrangements with the carrier alone.
Collection is from Unit 2, 28 Lionel Donovan Drive, Noosaville. Wait until we confirm your order is ready and check the collection hours provided in that notification. After-hours collection is available only by prior arrangement.
Customer artwork and portfolio use
We will ask for your permission before using your artwork, brand name or completed order in our website gallery, social media or advertising. Permission to fulfil an order is separate from permission to promote our business using that work.
Keep your own artwork files and order specifications for reorders. We do not promise indefinite file storage. Reorders are subject to current pricing, garment availability and confirmation of specifications; materials or production methods may change between runs.
Online tools and privacy
We use Shopify and linked design, upload and ordering tools to provide our services. Separate provider terms may apply to use of those tools. They do not remove our responsibilities for orders you place with us. If an upload, payment or order confirmation fails, contact us before submitting or paying again.
Personal information and uploaded files are handled as described in our Privacy Policy. Do not upload unlawful material, infringe other people’s rights, submit malicious files or misuse our website. We may pause or decline affected work for a reasonable legal, safety or security concern, explain the issue where appropriate and account fairly for any payment received.
Problems returns and contact
Change of mind and order errors
We do not offer change-of-mind returns for correctly supplied custom printed or embroidered garments, made-to-order transfers or precision-cut orders. This includes choosing the wrong size or approving incorrect wording where we have correctly followed your instructions. Contact us promptly if you notice an error before production so we can check whether it can be changed.
For ready-made merchandise, we do not offer change-of-mind returns unless a different policy is displayed for that product before purchase. These policies do not affect rights concerning faulty goods or services, incorrect supply or products that do not match their description.
Faults and Australian Consumer Law
Our goods and services come with rights and guarantees under the Australian Consumer Law where it applies. Custom-made items are not automatically excluded. Depending on the problem, you may be entitled to a repair, replacement, refund, cancellation or compensation.
For a major failure with goods, you can choose a refund or replacement. For a minor failure, we may provide a repair or other appropriate remedy within a reasonable time. If it is not fixed within a reasonable time, further rights apply. Service failures may give you rights to have the work corrected, cancel the service, receive a refund for the unused portion or obtain compensation, depending on the circumstances.
Please contact us as soon as you notice a problem and provide your order number or other proof of purchase, a description and photographs where practical. We may need to inspect the goods. We will explain how to return affected items and cover reasonable return costs where a fault is confirmed. Original packaging is not a condition of a statutory remedy.
There is no blanket 14-day deadline for reporting faults. Your legal rights can continue beyond a store warranty or stated return period. Normal wear, misuse and damage caused by not following appropriate care instructions are assessed separately from manufacturing or production faults.
Resolving a concern
Please contact us first so we can understand the issue and work towards a fair solution. Email hello@sweatshopnoosa.com.au with your order details. You can also write to us at Unit 2, 28 Lionel Donovan Drive, Noosaville QLD 4566.
This process does not prevent you from seeking help from Queensland Office of Fair Trading, a relevant tribunal or court, or exercising any other legal right. We do not impose a blanket exclusion for loss caused by our negligence or breach of statutory obligations.
Updates and governing law
The version of these terms made available when you place your order applies to that order. Later website updates apply to future orders unless we mutually agree otherwise or a change is required by law.
These terms are governed by Queensland law and applicable Australian law. Nothing here removes any mandatory rights or access to a court or tribunal available to you under applicable law. If part of these terms cannot lawfully be enforced, the remaining terms continue to apply to the extent permitted by law.
